Terms of Service

These Terms of Service govern access to and use of the MOSKIVO online store, including purchases made through the store.

By accessing the store or placing an order, you agree to these Terms, subject to any consumer rights that cannot legally be waived.

Online Store

The MOSKIVO store is hosted by Shopify, which provides the ecommerce platform used to display and sell our products.

You must be legally capable of entering into a purchase agreement in your jurisdiction or use the store with the authorization of a parent or legal guardian.

You may not use the store or its products for unlawful or unauthorized purposes.

Product Information

We make reasonable efforts to display product descriptions, specifications, colors, measurements, photographs, prices, and availability accurately.

Screen settings, lighting, manufacturing updates, and reasonable production variations may affect appearance. Minor variations that do not materially affect a product’s function are not necessarily defects.

If an error materially affects an order, MOSKIVO may contact the customer to offer correction, substitution, cancellation, or refund, as appropriate.

Prices and Payments

Prices are displayed in the currency selected or presented by the store.

Currency conversions may be approximate and may vary according to Shopify, payment providers, banks, or exchange rates. The final amount is shown during checkout.

Customers agree to provide current, accurate, and complete billing and payment information.

MOSKIVO may correct pricing or product information errors and may cancel an affected order before shipment. If payment has already been collected for a canceled order, the appropriate refund will be issued.

Orders

An order confirmation acknowledges receipt of an order but does not necessarily constitute final acceptance.

MOSKIVO may review, reject, limit, or cancel an order for legitimate reasons, including:

• Product unavailability

• Suspected fraud

• Payment problems

• Pricing or listing errors

• Delivery restrictions

• Violation of these Terms

If an order is canceled after payment, the corresponding amount will be refunded, subject to applicable law.

Shipping

Shipping, tracking, delivery estimates, customs, and address responsibilities are governed by our Shipping Policy.

Delivery dates are estimates unless expressly guaranteed in writing.

Returns and Refunds

Returns, damaged products, incorrect products, replacements, and refunds are governed by our Refund and Return Policy.

Nothing in these Terms limits mandatory consumer rights.

Proper Product Use

Customers must read and follow all instructions, warnings, charging requirements, maintenance recommendations, and safety information supplied with a product.

Products must be used only for their intended purpose. Children should use or access electrical products only under appropriate adult supervision.

MOSKIVO is not responsible for damage resulting from misuse, unauthorized modification, failure to follow instructions, or use contrary to product warnings, except where applicable law provides otherwise.

Intellectual Property

The MOSKIVO name, branding, store design, original text, graphics, photographs, and other store content are owned by or licensed to MOSKIVO and are protected by applicable intellectual property laws.

You may use the store for personal shopping purposes. You may not reproduce, distribute, modify, exploit, or commercially use protected store content without prior written permission.

Third-party trademarks and content remain the property of their respective owners.

Prohibited Conduct

You may not:

• Use the store for illegal, fraudulent, or abusive activity

• Attempt to interfere with store security or functionality

• Introduce malicious code

• Collect information about other users without authorization

• Misrepresent your identity or payment information

• Infringe intellectual property or privacy rights

• Use automated systems to access the store in a manner that disrupts its operation

Third-Party Services

The store may rely on third-party services, including Shopify, payment processors, Zendrop, suppliers, carriers, analytics providers, and other technology services.

MOSKIVO is not responsible for independent third-party websites or services, except to the extent responsibility cannot legally be excluded.

Disclaimer

We make reasonable efforts to maintain the store and provide accurate information. The store may occasionally be interrupted, delayed, or affected by technical issues outside our reasonable control.

Products and services are provided subject to applicable product descriptions, warranties, and mandatory legal protections.

Nothing in these Terms excludes warranties, guarantees, remedies, or liabilities that cannot legally be excluded.

Limitation of Liability

To the maximum extent permitted by law, MOSKIVO will not be liable for indirect, incidental, or consequential losses that were not reasonably foreseeable from the purchase or use of the store.

This limitation does not apply where liability cannot legally be excluded or limited, including mandatory consumer protections and liability arising from fraud or intentional misconduct.

Indemnification

To the extent permitted by law, you agree to be responsible for losses reasonably resulting from your unlawful use of the store, violation of these Terms, or infringement of another person’s rights.

This provision does not restrict any mandatory consumer right.

Governing Law

These Terms are governed by the laws applicable to MOSKIVO’s operation in Mexico, without depriving consumers of mandatory protections available under the law of their place of residence.

Changes to These Terms

MOSKIVO may update these Terms to reflect operational, commercial, or legal changes. The revised Terms will apply from the date they are posted and will not retroactively reduce rights relating to previously completed purchases.

Severability

If any provision is found unenforceable, the remaining provisions will continue in effect to the extent legally permitted.

Entire Agreement

These Terms, together with the Shipping Policy, Refund and Return Policy, and Privacy Policy, constitute the terms applicable to use of the store and purchases from MOSKIVO.
